Terms and Conditions for SWISH Bunbury
1. Agreement to Terms
By utilising any facilities or services provided by SWISH Bunbury you agree to comply with the following terms and conditions. These terms constitute a legally binding agreement between you and SWISH Bunbury. Failure to adhere to these terms may result in the denial of access to the facilities and services.
2. Facility Usage
2.1. The facilities provided by SWISH Bunbury are intended for the practice and enjoyment of indoor cricket, golf and multisport activities only.
2.2. Users must adhere to all posted rules and regulations within the facility.
2.3. Use of the facilities is at the user's own risk. SWISH Bunbury shall not be liable for any injuries, damages, or losses incurred during the use of the facilities.
2.4. Patrons participating in any competitions or events must abide by rules and regulations outlined by SWISH Bunbury, including specified entry fees and requirements.
3. Forms of Payment
3.1. Card and cash are accepted. SWISH Bunbury Pty Ltd use Square for all card payments which accepts cards bearing a Visa, MasterCard, American Express, Discover, JCB or UnionPay Logo.
3.2. All payments are to be made in full at the time of booking or prior to use of facilities.
4. Eligibility
4.1. Users must meet any age requirements specified by SWISH Bunbury to utilise the facilities.
4.2. Users under the age of 16 must be accompanied by a parent or guardian while using the facilities.
5. Code of Conduct
5.1. Users are expected to always conduct themselves in a respectful and sportsmanlike manner.
5.2. Any behaviour deemed disruptive, abusive, or unsafe by SWISH Bunbury staff may result in immediate expulsion from the premises.
6. Safety
6.1. Users must comply with all safety guidelines provided by SWISH Bunbury staff.
6.2. Proper attire, including appropriate footwear, must be worn while using the facilities.
6.3. Users are responsible for ensuring the safe use of equipment and facilities. Any concerns regarding safety should be reported to SWISH Bunbury staff immediately.
7. Equipment
7.1. Users are responsible for the care and proper use of any equipment provided by SWISH Bunbury.
7.2. Any damage to equipment or facilities caused by misuse or negligence may result in financial liability for the user.
8. Reservation and Cancellation Policy
8.1. Reservations for facility usage may be required and are subject to availability.
8.2. Users must adhere to the cancellation policy outlined by SWISH Bunbury.
9. Liability
9.1. SWISH Bunbury shall not be liable for any injuries, damages, or losses incurred by users while utilising the facilities or services, except where such injuries, damages, or losses are directly caused by the negligence of SWISH Bunbury or its staff.
10. Amendments
10.1. SWISH Bunbury reserves the right to amend these terms and conditions at any time without prior notice. Any amendments will be effective immediately upon posting on the SWISH Bunbury website or other official communication channels.

Coaching Terms & Conditions for SWISH Bunbury
1. Agreement to Terms
By booking a coaching lesson at SWISH Bunbury, you agree to abide by the terms and conditions outlined herein. These terms constitute a legally binding agreement between you (the "Student") and the coach (the "Instructor").
2. Lesson Booking and Payment
Lesson bookings are subject to availability and must be scheduled in advance.
Payment for lessons is due at the time of booking, unless otherwise arranged with the instructor.
The instructor reserves the right to cancel or reschedule a lesson due to unforeseen circumstances. In such cases, alternative arrangements will be made at the earliest convenience.
3. Cancellation and Refunds
Cancellations made by the student must be communicated to the instructor at least 24 hours before the scheduled lesson time. Failure to do so may result in forfeiture of the lesson fee.
Refunds for cancelled lessons will be provided at the discretion of the instructor.
In the event of unavoidable circumstances, the instructor may cancel a lesson. In such cases, the lesson fee will be fully refunded or credited towards a future lesson, as per the student’s preference.
4. Health and Safety
The student acknowledges that any sport is a physical activity that carries inherent risks. By participating in the lesson, the student assumes all responsibility for their own safety and wellbeing.
The student is responsible for informing the instructor of any medical conditions, injuries, or physical limitations that may affect their ability to participate in the lesson safely.
The instructor reserves the right to terminate a lesson if they believe that continuing would pose a risk to the student’s health or safety.
5. Conduct
The student agrees to always conduct themselves in a respectful and sportsmanlike manner during the lesson.
Any behaviour deemed disruptive or inappropriate by the instructor may result in immediate termination of the lesson, without refund.
6. Liability
The instructor shall not be liable for any loss, damage, or injury sustained by the student during the lesson, except in cases of negligence or willful misconduct.
The student agrees to indemnify and hold harmless the instructor from any claims, liabilities, or expenses arising from their participation in the lesson.
7. Photography and Video
The instructor may use photographs or video footage taken during the lesson for promotional or educational purposes, unless otherwise agreed upon with the student.
The student may request that their image not be used for promotional purposes.
8. Amendments
The instructor reserves the right to amend these terms and conditions at any time. Any changes will be communicated to the student in writing.
By booking a coaching lesson, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
